This document (together with all documents referenced within it) establishes the terms and conditions governing the use of this website – www.motan.ro (hereinafter referred to as "the Website").

The purpose of the Website is to present and promote the products from the Motan range manufactured by KOBER S.R.L. (boilers, water heaters, accessories for home heating, solar panels), to provide technical support for the use of these products, and to contract, through the Website, with potential customers interested in these services. Additionally, through the Website, KOBER S.R.L. recruits individuals with technical skills to join our team.

Please read these Terms and Conditions, the Cookie Policy, and the Privacy Policy before using the Website. By accessing and using the Website, you expressly acknowledge the binding nature of these documents and agree to comply with them.

WHO WE ARE

KÖBER S.R.L. is a successful company based in Piatra Neamț, founded in 1991 and owned by the Kober family, holding a market share of 20-21% of the national paint and varnish market. In a Romanian market dominated by foreign products, in 2002, the KÖBER group launched the first Motan boiler, a 100% Romanian product that complies with all internationally imposed quality standards.

Motan heating systems are available in over 23 countries worldwide, being one of the Romanian products that proudly represent our country. The production (of wall-mounted condensing boilers, integrated home heating systems, water heaters, and the range of accessories for home heating) is carried out entirely in the factory located in the village of Vaduri, Neamț County, where there is also a laboratory dedicated to the development of new solutions for home heating.

INTELLECTUAL PROPERTY

The company holds exclusive rights to all intellectual property related to the content of the Website, including but not limited to: articles, text, photographs, illustrations, music, audio and video clips, trademarks, logos, and designs.

Visitors to the Website may access, download, and print materials published on the Website, free of charge, solely for personal use and for non-commercial purposes. By doing so, visitors do not acquire any rights, titles, or legitimate interests in the materials published on the Website.

No section of the Website's content, for which the Company holds intellectual property rights, may be reproduced, distributed, or published in any form, for any purpose, or by any means, without the prior written consent of the Company.

Therefore, visitors to the Website declare that by simply using the Website, they understand and agree not to copy, modify, sell, distribute, transmit, display, reproduce, publish, or create derivative works based on the information published on the Website.

TERMS

Seller/Company – KOBER S.R.L.
Visitor – Any natural/legal person interested in the specific products offered by the Company and who has access to the Website content.
Client – A natural/legal person who has access to the specific products offered by the Company through the Website and through any communication means provided by the Company (electronically, by phone, by completing forms available on the Website), following direct contact with the Company's representatives and subsequent discussions, after which a specific contract is concluded between the parties.
Site – The online store hosted at the web address motan.ro;
Specific products – Products presented on the Website in the "Our Products" section (*Boilers, *Water Heaters, *Accessories for home heating, *Solar Panels), respectively in the "Product Catalog", "Unpressurized Solar Panels" sections – for the purpose of selling them to the Company’s Clients.
Commercial Communications / Newsletter – Refers to any type of message sent (email, phone, mobile push, web push, etc.) containing general and thematic information, offers/services similar or complementary to those purchased from the Website, etc.

USING THE WEBSITE

Through the Website, the Company invites the Website visitor, i.e., the potential Client/partner, to contract the services and products offered by the Company.

By using the Website, you agree:

• Not to make any false or fraudulent requests/orders for contracting specific products of the Company. If we have reasonable grounds to believe that such a request or order has been made, we have the right not to respond and to inform the competent authorities accordingly.

• To provide your full name, email address, and/or other correct and accurate contact information. If you do not provide all the information we need, we may not be able to respond to your request.

By using the Website in any manner and for any purpose, you declare that you meet the legal conditions and that you have the capacity to enter into legal acts that impose obligations on you as outlined in the Terms and Conditions, Privacy Policy, and Cookie Policy.

Simply using the Website and/or submitting a product request via the forms provided, and the response to this request, do not oblige the Company in any way to the visitor/potential Client, nor do they constitute the conclusion of a contract between the Company and the visitor/potential Client.

The visitor or potential Client will contact the Company using any of the contact details published on the Website (under the "Contact," "How to Buy?" and "Service and Setup" sections) and listed in section 1 of these Terms and Conditions, for the purpose of purchasing the products presented, arranging for their installation, and engaging in service activities, as well as for concluding a service contract. The respective contract will set out all essential elements, in accordance with the law, as well as specific elements such as: the obligations and rights of the Parties, the price of contracted services, warranties, responsibilities, etc.

Additionally, through the Website, the Company recruits individuals with technical skills to join our team. By pressing the "Career" section, the potential candidate chooses a job or profession available at the Company, completes the details in the Form (name, email, phone number, uploads their CV, and any additional information they wish to provide in the "Message" section), and clicks the "Submit" button to establish future contact arrangements.

LIMITATION OF LIABILITY

The Company assumes no liability for any damages that the Website visitor, potential Client, or any third party may suffer as a result of using the Website in any manner or for any purpose, or as a result of the Company's fulfillment of its legal and/or contractual obligations.

The visitor/potential Client uses the products offered through the Website entirely at their own risk. They are responsible for maintaining confidentiality regarding the information transferred/received via the Website and for processing it in accordance with the legal provisions regarding personal data protection.

OUR RIGHT TO MODIFY THE TERMS AND CONDITIONS

We have the right to occasionally and at our discretion review and modify the Terms and Conditions.

You are responsible for reading the entire Terms and Conditions, Cookie Policy, and Privacy Policy, as the applicable version will be the one in effect at the time of using the Website.

APPLICABLE LAW AND JURISDICTION

The use of the Website and the conclusion, execution, and termination of contracts concluded with the Company through the Website will be governed by Romanian law.

Any disputes arising from or related to the use of the Website or the conclusion, execution, and termination of these contracts will be resolved amicably, or if that is not possible, disputes will be settled by the competent Romanian courts.

PROCESSING PERSONAL DATA

The processing of personal data by the Company is carried out in accordance with Regulation (EU) 2016/679 of the European Parliament and the Council of April 27, 2016, on the protection of individuals regarding the processing of personal data and on the free movement of such data, and the repeal of Directive 95/46/EC ("General Data Protection Regulation") and the relevant national legislation regarding personal data protection.
